Sunset Clause Release

Sunset Clause Release of Exploration Reports

Under Regulation 96(4) of the Mining Act, Mineral Exploration Reports held by the Department for 5 years may be released to Open File.

On 20 April 2009, the Department will begin releasing reports submitted during the period:

  •  12 April 2001 to 31 December 2003

A PDF file containing a list of these reports is attached below. This list is seachable by the following attributes:

  • Report 'A' number
  • Date submitted
  • Time period of the report
  • The Report title
  • The tenements in the reports
  • The current tenement holder/s of the tenements covered by the report, or subsequent tenement granted in renewel or substitution for the tenement/s in the report. Where a tenement may have died, the holder at that time is listed.

Most reports have multiple entries. This allows searching on all tenement holders and tenements associated with individual reports.

If a report in the list is requested for viewing, the Department will charge $50 to retrieve a hard copy or $20 for a digital copy (where available).

Objections to release

Regulation 96(5) of the Mining Act gives the current holder of a mining tenement covered by the report, or any subsequent tenement granted in renewal of or substitution for such a mining tenement, the right to object to the release of the report.

These objections must be in writing, with specific details justifying the request for non-release of reports, and must specify the 'A' number of the report.

Objections which are most likely to be considered favourably will fall within the following categories:

Reason Documentation or further information required from tenement holders
Existence of previously undisclosed resource estimates or other information that is likely to influence the stock market valuation of the tenement holder Identify the particular resource estimate or information and explain why it will influence the stock market
Continuation of commercial agreements entered into prior to promulgation of Regulations 96(4), (5), and (6) of the Mining Regulations that relate to rights in exploration data between a tenement holder and another party (ie.pre. 1995) A copy of the relevant agreement

Reports which have been released to Open File will not be withdrawn if an objection is received subsequent to the report's release.
