CPS 9804/1 Decision Note: The decision is seriously at variance with Clearing Principle (b). Under Section 51O of the Environmental Protection Act 1986 (EP Act) the CEO may make a decision that is seriously at variance with the clearing principles if in the CEO’s opinion there is good reason for doing so. Under Section 51Q of the EP Act this reason must be recorded and published.

 CPS 9804/1 Reason for Decision: The CEO considered that the limestone within the permit area has been identified as a significant geological supply under State Planning Policy 2.4 and is required to support the larger Mitchell Freeway extension project, the Alkimos Seawater Desalination Plant and in the construction of houses.  The CEO noted that the Mitchell Freeway extension will provide social and economic benefit including improved network connectivity, accessibility and road safety for all road users.  The CEO noted that the Alkimos Seawater Desalination Plant will aid help reduce dependence on rainfall and groundwater and will aid in the security of water sources into the future accounting for a drying climate and population growth. The CEO considered avoidance, mitigation and offset measures in making this decision. The reasons for the decision are detailed further within Section 1 of the Decision Report  

Appeals against a grant of a clearing permit , appeals against the refusal to grant a permit, refusal to permit all clearing;
an amendment, revocation or suspension of a clearing permit; or the conditions of permit must be made within 21 days
of the applicant receiving notification of the decision.
